Berkshire has a number of Special Areas of Conservation, Special Protection Areas and Ramsar sites both within the county boundary and in close proximity to the boundary. These sites are high quality sites that will make a significant contribution to the conservation of habitats and species, which are most in need of protection. The sites are strictly protected by the European Habitats Directive (Directive 92/43/EEC), which has been transposed into national legislation in the Conservation (Natural Habitats &c) Regulations 1994. This legislation requires an Appropriate Assessment to be carried out of any plans or projects which are likely to have a significant effect on these protected areas.
Policies and sites in both the Minerals and Waste Core Strategy and the Detailed Minerals and Waste Development Control Policies and Preferred Areas need to be considered to determine if they need an Appropriate Assessment.
The first stage of the Appropriate Assessment is a screening process which aims to establish whether the proposals within the DPDs will have a likely significant effect on the various European and Ramsar sites within and around Berkshire.
The second stage is the production of a screening report of the draft DPD to assess whether recommendations made in the AA report have been included in the DPD.
The third stage will comprise the review of comments made during consultation with Natural England and other statutory consultees; any outstanding issues will be addressed.
